What Parents Need to Know About Special Education Law and Procedures

The purpose of the Individuals with Disabilities Education Improvement Act of 2004 (IDEA) is to ensure that all children with disabilities have available to them a free appropriate public education that emphasizes special education and related services designed to meet their unique needs and prepare them for further education, employment, and independent living. The intention of this series of programs is to explain in simple, understandable terms how school districts implement IDEA and what parents can expect from the process. The presentation also emphasizes the role of parents in the process of implementing an appropriate education for their children.

To qualify for special education and related services under IDEA, a student must meet the definition of one or more of the categories of disabilities specified under IDEA and must be shown to be in need of special education and related services as a result of his disability. A determination as to whether this criteria is met occurs through IDEA’s evaluation process. This series of programs will define the categories of disabilities, give parents a better understanding of the special education “alphabet”, and explain the identification and evaluation process.

At the beginning of each school year each school shall have an written individualized education program (IEP) in effect for each child with a disability developed by the IEP team. This series of programs will define the members of the IEP team (which includes the parents) and explain how the IEP team develops an individualized education program for each qualified child.

Parents have a number of rights under IDEA procedures, including the right to receive procedural safeguards, the right to mediation, resolution sessions, and/or a due process hearing. This series of programs will define all parental rights and explain the entire dispute resolution process.

The parents and/or school district personnel who participate in this series of programs can expect to benefit as follows:
  • an overview of the IDEA statutes, proposed regulations and case law;
  • increased understanding of how consensus can be reached in an IEP meeting which will determine a free appropriate public education program for each disabled child;
  • knowledge of procedural safeguards, mediation, resolution sessions, and due process hearings, emphasizing the changes found in IDEA 2004

Section 504

Jean Rawson presents six 45-minute segments on Section 504 of the Rehabilitation Act of 1973, and the relevant information that district level and site administrators need to know. These segments provide the basis for Section 504 training that is required for staff.

Special Education Legal Updates
Jean Rawson, special education attorney, presents quarterly updates on special education law, and pertinent and current special educations cases. The updates are about 60 to 90 minutes long, and provide excellent information for special education administration and staff and are also informative for general education administration.
